Summerly Operator Agreement
Version 2026-10-02
1. Who this is between
This agreement is between Summerly and you, the camp operator taking registrations and payments through Summerly ("you"). It applies in addition to the Summerly Terms of Service. If they conflict on hosted registration, this agreement controls.
2. Summerly's role
You are the seller of the camp registrations families buy through Summerly, and your business name appears on their card statement. Families pay you directly: each payment is made to your own connected Stripe account. You authorize Summerly to create those payments for you, and to issue refunds and respond to disputes on your behalf under this agreement.
Payments are processed by Stripe on your connected account, under your own agreement with Stripe. Stripe charges its card-processing fee to your account and sends you any tax forms it is required to (such as a 1099-K) for those payments. You run the camp and are responsible for its program, staff, safety, facilities, licensing and insurance, and for any taxes due on your program fees.
3. Fees
Summerly's platform fee is 3.5% of each registration for your own families and 10% for families Summerly sends you, never more than $40 per registration. It is taken from each payment as the payment is made. There is no monthly or setup fee.
A family is treated as sent by Summerly only if they found your camp on Summerly's discovery pages within 30 days of booking, did not arrive through your storefront link, and have not booked with you before (through Summerly or on a roster you imported). Anything else is your own family. Your roster shows which applied to each booking.
Families also pay a Summerly service fee (3.5% + 30¢) as a separate line at checkout. It pays Stripe's card-processing fee on the payment, so that fee does not reduce your share; what is left of it is Summerly's.
Founding operators — the first 15 operators to connect payments — pay no platform fee on registrations from their own families booked on or before May 31, 2027. Registrations from families Summerly sends you carry the rate above for families sent by Summerly, founding or not. Your dashboard shows whether this applies to you.
Summerly may change these fees for future bookings with 30 days' notice. A booking always keeps the fee in force when it was made.
4. When you're paid
Money is released to you as soon as the family can no longer get it back under your cancellation policy, less a 10% reserve held until the session starts. Releases are made at most every 7 days. Stripe separately delays a new account's first payout while it verifies you.
Summerly holds back money that could still be refunded because refunds and chargebacks are paid out of your Stripe balance, and the money has to be there to pay them.
5. Cancellations and refunds
You choose one of Summerly's published cancellation policies for each camp. Families see it before paying; the policy in force when they booked applies to their booking. When a family cancels, Summerly refunds what the policy allows and releases the spot automatically.
You may refund more than the policy requires at any time from your roster. If you cancel a session or cannot deliver what a family paid for, you must refund them in full.
Refunds are paid from your Stripe balance. When a family cancels, Summerly returns its platform fee on the refunded amount to you. If money has already been released to you and your balance cannot cover a refund, Stripe recovers the shortfall from your later payments or your bank account, under your agreement with Stripe.
Stripe does not return its card-processing fee when a payment is refunded. When a family cancels, the service fee they paid covers it. When you cancel a session or refund a family in full, the family's service fee is refunded too, and Stripe's fee on that payment is yours.
6. Chargebacks
If a family disputes a payment, Stripe takes the disputed amount out of your Stripe balance while the bank decides, and returns it if the bank decides for you. You agree to provide evidence Summerly reasonably requests within 5 business days; you can also respond to the dispute yourself from your Stripe dashboard. If the dispute is lost, the disputed amount and Stripe's dispute fee are yours, and Summerly returns its fee on the disputed amount to you.
7. Camper data
Camper, guardian, emergency-contact, medical and waiver records for your camps are yours. You may export them at any time. You agree to use them only to run your programs, to keep them confidential, and to comply with the privacy laws that apply to you. Summerly processes them on your behalf to run the service and does not sell them.
8. Your listings
You're responsible for the accuracy of your listings, prices, dates, age ranges and policies. Summerly may pause hosted registration for a camp that misrepresents its program, has unresolved safety concerns, or accumulates excessive disputes.
9. Ending this agreement
Either of us may end hosted registration with 30 days' notice. Bookings already made are completed under the terms in force when they were made, including refunds and payouts. On request we provide a final export of your camper data and delete it afterwards.
